Terms of Service

1. Acceptance of Terms
By accessing or using the TTClassify platform and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Service Description
TTClassify provides a tariff classification platform that enables users to determine Harmonized System (HS) codes for traded goods. The Service includes classification tools, ruling intelligence, compliance reporting, bulk processing capabilities, and API access, subject to your subscription tier.
3. User Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You agree to:
- Provide accurate and complete registration information
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorized access to your account
- Not share account access with unauthorized individuals
4. Subscription & Billing
The Service is offered under subscription plans as described on our Pricing page. By subscribing, you agree to pay the applicable fees for your selected plan. Key billing terms:
- Subscriptions renew automatically at the end of each billing period
- You may upgrade, downgrade, or cancel at any time; changes take effect at the next billing cycle
- Refunds are provided on a pro-rata basis for annual plans canceled within the first 30 days
- We reserve the right to adjust pricing with 30 days' notice
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to facilitate illegal trade activities
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service
- Circumvent usage limits, rate limits, or access controls
- Transmit malware, viruses, or any code designed to disrupt the Service
- Resell, sublicense, or redistribute the Service without prior written consent
- Scrape, harvest, or extract data from the Service by automated means beyond authorized API use
6. Intellectual Property
Our IP: The Service, including its software, algorithms, design, documentation, and trademarks, is owned by TTClassify and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.
Your Data: You retain full ownership of all product descriptions, classification data, and other content you submit to the Service. You grant us a limited license to process this data solely to provide the Service.
7. Classification Disclaimer
TTClassify provides classification suggestions based on product descriptions and historical customs rulings. These are intended as decision-support tools and do not constitute legal or customs advice. Final classification responsibility lies with the importer of record. We recommend consulting with licensed customs brokers for binding rulings.
8. Service Availability & SLA
We strive to maintain 99.9% uptime for Enterprise customers and commercially reasonable uptime for all other plans. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors beyond our reasonable control, including internet outages, force majeure events, or third-party service failures.
9. Limitation of Liability
To the maximum extent permitted by law, TTClassify's total liability to you for any claims arising from the Service shall not exceed the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, customs penalties, or trade disruptions.
10. Termination
Either party may terminate the subscription at any time. We may suspend or terminate your access immediately if you violate these Terms. Upon termination:
- Your access to the Service will cease
- You may export your data within 30 days of termination
- We will delete your data in accordance with our Privacy Policy
- Outstanding fees remain payable
11. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any disputes shall be resolved through binding arbitration in Wilmington, Delaware, under the rules of the American Arbitration Association.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email at least 30 days in advance. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
